The use of words such as ‘we’ ‘us’ and ‘Our’ is about Trigon Fitness Ltd a company registered in Northern Ireland under the company number NI1684546.’ You’ or ‘your’ is a reference to the person to whom we are supplying Goods and who is required to pay for the Goods we supply.
‘Goods’ means the items purchased through our website/phone/email and which you will be paying for.
1.1 Trigon Fitness requires full payment of the goods that you order before we can accept the order. Once the payment has been received by us we will confirm that we have accepted the order by sending an email to you at the email address that you provided on the order form. Once we have accepted the order this brings into existence a legally binding contract between us.
2.1 The prices for the goods that you order are laid out on the website as well as a total price in the shopping cart.
2.2 You will be required to pay extra for delivery, the prices of the delivery are set out on the website.
2.3 If the cost of the Goods to us increases due to any factor beyond our control including, but not limited to, material costs, labour costs or changes to delivery rates, we can increase the Price before delivery.
2.4 Any increase in the Price under the clause above will only take place after we have told you about it.
3. Right to Cancel
3.1 You may cancel your contract with us for the Goods you order at any time up to the end of the 14th working day from the date you receive the ordered Goods. You do not need to give us any reason for cancelling your order nor will you have to pay any penalty.
3.2 To cancel your order you must contact us via email at firstname.lastname@example.org
3.3 If you have received the goods before you cancel your order then you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the Goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.
3.4 Once you have notified us that you are cancelling your order, any sum debited to us from your credit card will be credited to your account as soon as possible and in any event within 5 working days of your order provided that the Goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the Goods from the amount to be credited to you.
3.5 No refunds will be offered for custom/personalised equipment, unless damaged or faulty.
4. Cancellation by Us
4.1 We strive to keep the majority of the products listed on our website in stock at all times. Occasionally some items are out of stock. If you order an item that is out of stock, we will contact you within 24 hours (1 working day) and advise you when the item is due back in or of any available, comparable product.
4.2 We reserve the right to cancel the order if one or more of the Goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information.
4.3 If we cancel your order we will notify you by email and will credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 14 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
4.4 In Circumstances beyond the control of either party, Neither party shall be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that party. Such as but not limited to fire, flood, Power loss, governmental action or any other event that is beyond the control of the party in question.
5.1 If the Goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by emailing us the problem within 10 working days of the delivery of the Goods in question.
5.2 If you do not receive the goods ordered within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us by emailing us the problem within 40 days of the date on which you ordered the Goods.
5.3 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
6.1 We guarantee your privacy and we will never pass your information onto any third party.
7.1 Standard Warranty- This Warranty covers the defects resulting from defective parts, materials or manufacturing if such defects are revealed during the period of 24 months for all structural steel and welds since the date of purchase and 12 months for all mechanical parts since the date of purchase.
8.1 If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
